These terms cover your use of TheDigitalChef's website (thedigitalchef.com) and any mobile applications we publish, including Raceboard (collectively, the "Services"). By using the Services you agree to them. If you don't, please don't use the Services.
Who we are
TheDigitalChef is an independent software studio operated by Stijn Kramer, based in the Netherlands. Reach us at info@thedigitalchef.dev.
The Services
We make small, focused software for iPhone and iPad. We try hard to keep it working well, but we offer the Services on an "as is" basis and reserve the right to change, suspend, or discontinue any feature at any time. Where we charge for an app, the App Store handles the transaction under Apple's terms; refund policies are governed by the relevant App Store.
Your account and content
Some apps may let you store preferences, lists, or other content on your device or sync it through Apple iCloud. You retain ownership of your content. You're responsible for keeping a backup of anything you can't afford to lose.
Acceptable use
You agree not to:
- Reverse-engineer, decompile, or attempt to extract source code from any app, except to the extent that local law expressly permits this
- Use the Services to do anything illegal, abusive, or harmful to others
- Interfere with the integrity or performance of the Services, or attempt to gain unauthorised access to them
- Resell, sublicense, or redistribute any app outside of the App Store distribution we've set up
Intellectual property
The Services, including all source code, designs, brand marks ("TheDigitalChef", "Raceboard"), copy, and graphics, are owned by TheDigitalChef or our licensors and are protected by Dutch and international copyright, trademark, and other laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Services for their intended purpose. Nothing here transfers ownership of the Services to you.
Third-party services
The Services rely on third parties (Apple, Firebase / Google Cloud, and similar). Their terms also apply to your use of those parts of the Services. We are not responsible for the availability or behaviour of third-party services.
Disclaimer
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranty of any kind, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, timely, secure, or error-free, or that any data they show is accurate or complete. Race results, timings, weather, and similar information shown by our apps are for convenience only and must not be relied on for safety-critical decisions.
Limitation of liability
To the maximum extent permitted by law, TheDigitalChef will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or relating to your use of the Services. Our total liability for any claim arising out of these terms or the Services is limited to the greater of (a) the amount you paid for the relevant app in the twelve months preceding the claim, or (b) ten euros. Nothing in these terms limits liability that cannot be excluded under Dutch law, including liability for fraud, gross negligence, or intentional misconduct.
Indemnity
You agree to indemnify and hold TheDigitalChef harmless from any claim arising out of your misuse of the Services or your breach of these terms.
Termination
You may stop using the Services at any time by deleting the relevant app or no longer visiting the website. We may suspend or terminate your access if you breach these terms or if we discontinue the Services. Provisions that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will continue to apply.
Governing law
These terms are governed by the laws of the Netherlands. Any dispute arising out of or relating to these terms or the Services will be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands, unless mandatory consumer protection law in your country of residence requires otherwise.
Changes
We may update these terms from time to time. If we make a material change we'll update the date at the top of the page. Your continued use of the Services after the update means you accept the new terms.
